Terms and conditions

These Terms and Conditions are valid from 20 July 2025.
The Terms and Conditions are prepared in both Czech and English.
In case of any discrepancies, the Czech version of the Terms and Conditions shall prevail.
All offered models are the original work of Ing. Ondřej Lokaj.
Any sharing or sale of purchased .STL model files, including individual parts, created by the author, is strictly prohibited!

I. General Terms and Conditions

1. Introductory Provisions

1.1. These Terms and Conditions have been prepared in accordance with Act No. 89/2012 Coll., the Civil Code of the Czech Republic, as amended. All purchases and legal relationships arising therefrom shall be governed by the laws of the Czech Republic.
1.2. These Terms and Conditions (hereinafter referred to as the “Terms”) govern the mutual rights and obligations of the seller and the buyer when purchasing electronic files intended for 3D printing of RC models (hereinafter referred to as “files”) or various kits and physical products (hereinafter referred to as “kits”, “physical products”), purchased on the website www.rcmodelsfactory.com
1.3. For the purpose of these Terms, a “model” refers to an RC model, a static model, or a part thereof, created using the files, kits, or physical products offered by the seller.
1.4. The seller is Ing. Ondřej Lokaj, Vyškov 682 01, Czech Republic, ID No.: 11899204.
1.5. The buyer is any natural or legal person who has purchased files from the seller.
1.6. These Terms form an integral part of the purchase contract concluded between the seller and the buyer.
1.7. The Terms are further divided into: I. General Terms and Conditions, II. Terms and Conditions – Downloadable Electronic Files, and III. Terms and Conditions – Physical Products

2. Personal Data Protection

2.1. All information provided by the buyer will be used solely for processing the order and will not be shared with third parties, except for those involved in order fulfillment (e.g., courier services).

3. Copyright

3.1. All files and models are protected by copyright and are intended for personal and non-commercial use only.
3.2. The buyer agrees not to distribute, sell, or provide the files and models to third parties.
3.3. Any modification, distribution, transmission, reproduction, publication, copying, remixing, or sale of any part or mechanics of the model is strictly prohibited without prior written, explicit, and personally signed consent from the model’s author. The model and its mechanics are protected under copyright law. Any breach of these conditions will result in legal action with all related consequences.
3.4. Sharing or selling the files to third parties for profit is strictly and unconditionally prohibited.
3.5. Commercial use of models printed using the purchased files is strictly and unconditionally prohibited.
3.6. Infringement of copyright constitutes a breach of copyright law and will be prosecuted accordingly.

4. Orders

4.1. Orders can be placed via the e-shop, contact form, or in writing via the contact email listed on the seller’s website.
4.2. Orders sent by email by the buyer are not binding for the seller.
4.3. An order submitted under 2.2 becomes binding only after it is confirmed by the seller.
4.4. While the seller aims to accept all orders, the seller may refuse an order in certain cases, for example:

4.4.1. The seller is unable to fulfill the order due to high demand and may offer an alternative solution.
4.4.2. The buyer provides incomplete, incorrect, or fraudulent information regarding identity, age, payment details, billing or shipping address, etc.
4.4.3. The seller discovers an error on the website regarding the ordered products, such as an obviously incorrect price or product description.
4.4.4. The ordered products are out of stock or no longer available.

5. Payment Information

5.1. Buyer can pay for the products in the following currencies: Euro (EUR), Czech Crown (CZK), US Dollar (USD), Australian Dollar (AUD), British Pound (GBP), Japanese Yen (JPY), Canadian Dollar (CAD), Swiss Franc (CHF), Polish Zloty (PLN), Hungarian Forint (HUF).
5.2. The buyer is responsible for any bank fees or currency conversion fees.
5.3. The stated price for products is final.
5.4. Payment is considered completed when funds are credited to the seller’s account.
5.5. Full payment received in the seller’s account is required to fulfill the buyer’s payment obligation. For security and processing reasons, the seller does not consider proof of payment alone.
5.6. The seller is not responsible for payment errors made by the buyer.

Bank account details are sent with the order confirmation.
Payments are only accepted in EUR and CZK.

6. Support and Warranty

6.1. The seller provides support only for the purchased files, not for model assembly.
6.2. The seller reserves the right to provide support for model assembly at their discretion.
6.3. All electronic files are tested and fully functional. However, the seller does not guarantee functionality with all types of 3D printers, slicer software, or when incorrect slicer or printer settings are used.
6.4. Support is provided via email at: info@rcmodelsfactory.com
6.5. Support is also available in a dedicated community group on Facebook. A link can be found on the website and in the model assembly instructions.
6.6. Support via communication platforms such as Facebook Messenger or WhatsApp is not available.
6.7. The seller reserves the right to provide technical support exclusively for sold files and products.
6.8. The seller reserves the right to refuse technical support for sold files and physical products if:

6.8.1. Unreasonable customer requests – such as demanding different file formats than those originally purchased.
6.8.2. Modification or misuse of files – if the customer altered the purchased files or products or used them contrary to the manual or license terms.
6.8.3. Incompatible environment/devices – if the support request concerns use in an incompatible environment or with incompatible equipment.
6.8.4. Violation of terms or abuse of support – if the customer violated the terms or otherwise misused the support service.
6.8.5. Illegally obtained files – if the files were obtained illegally or without a valid license.
6.8.6. Inappropriate behavior – if the customer behaves inappropriately or unethically.

6.9. Technical support includes providing information, answering questions, and resolving any technical issues related to the sold files and physical products.

7. Accuracy of Website Information

7.1. The seller makes every effort to ensure that product information is accurate and up to date. However, they do not guarantee that there will be no errors in the product description and/or price, or that products will always be available for purchase.
7.2. The seller reserves the right to amend product information shown on the website, including prices, descriptions, and availability.
7.3. Product and packaging images may be computer-generated and do not necessarily represent the final kits. All photos are for illustrative purposes only. Models shown on the website may be hand-built prototypes or completed models belonging to customers, and they are used as illustrative examples. Therefore, the actual model may differ from the photos shown on the website or other seller channels.
7.4. Listed weights, dimensions, and specifications are approximate.

8. Product Accuracy

8.1. The manufacturer strives to create models as accurate representations of the original.
8.2. Models are based on research, measurements, and photographs of real vehicles. However, the manufacturer does not guarantee that the model will be an exact replica of the original. Visual or dimensional differences may occur.
8.3. Listed weights, dimensions, and specifications are approximate.
8.4. Although the manufacturer ensures the quality and performance of each kit, some parts may require post-processing (e.g., filing or drilling) before assembly.

9. Miscellaneous Provisions

9.1. The buyer acknowledges that files are delivered in digital format and not physically.
9.2. The listed prices for individual items are final. The buyer is not entitled to a refund in case of a price change after purchase. Prices may change over time based on costs.
9.3. The seller reserves the right to amend these Terms and Conditions. Amendments become effective upon publication on the seller’s website and apply to purchase agreements concluded after the publication date.

10. Final Provisions

10.1. These Terms and Conditions are valid and effective from the date stated at the beginning of this contract.
10.2. If any provision of this contract is deemed invalid, the remaining provisions shall remain in full force and effect.
10.3. The relationship between the seller and buyer is governed by these Terms and Conditions and applicable laws of the Czech Republic.
10.4. The seller reserves the right to modify these Terms and Conditions.
10.5. In case of discrepancies, the Czech version of the Terms and Conditions is binding.
10.6. In the event of the seller ceasing operations, suspending the e-shop, or terminating their business, technical support will automatically end without compensation. This does not affect the customer’s rights under applicable laws.

II. Terms and Conditions – Downloadable Electronic Files

1. Support and Warranty

1.1. See Section 4 of I. General Terms and Conditions.

2. Purchase of Files

2.1. The purchase agreement between the seller and the buyer is concluded upon the buyer’s submission of the order and its acceptance by the seller.
2.2. The buyer acknowledges that once the download link for the files has been provided, it is not possible to withdraw from the purchase agreement or request a refund.
2.3. The seller reserves the right to change product prices at any time. The price valid at the time of ordering is binding for the buyer.
2.4. By purchasing files intended for 3D printing, the buyer does not become the owner of the files. The buyer obtains only a single license to 3D print the model for personal, non-commercial use only.

3. File Delivery

3.1. After payment is received, a download link will be sent to the buyer’s email address. The files will also be made accessible in the buyer’s account, if one was created.
3.2. The seller commits to delivering the purchased files within 24 hours of confirming the order. The download link is usually provided immediately after purchase and payment. The seller will also send a link where updated or corrected parts for the purchased model can be found. The functionality of this link may be limited.
3.3. The link to modified, added, or corrected parts is included in the assembly manual or sent via email.
3.4. The seller will make every effort to deliver the purchased files as quickly as possible.
3.5. The download link is sent automatically, and file access is also provided via the buyer’s account on the website www.rcmodelsfactory.com.
3.6. The seller is not responsible for delivery delays caused by circumstances beyond their control, such as internet outages or technical issues with service providers.
3.7. The download link is valid for 30 days and limited to 3 downloads. If additional downloads are needed, please contact the seller, who may provide an alternative download link.

4. Liability

4.1. The seller is not liable for any damage caused by improper assembly or use of the files contrary to the instructions.
4.2. The seller is not liable for any damage caused by improper use or maintenance of the model.

III. Terms and Conditions – Physical Products

1. Delivery

1.1. Products will be delivered to the address specified by the buyer in the order.
1.2. Products ordered for delivery outside the Czech Republic or the European Union may be subject to import duties and taxes collected upon delivery.

1.2.1. The buyer is responsible for the payment of all import duties and taxes.
1.2.2. The seller is not liable for the payment of any duties or taxes on behalf of the customer.
1.2.3. Any additional duties and taxes shall be borne entirely by the buyer and cannot be claimed back from the seller in the event of a contract withdrawal.

2. Custom products

2.1. You may request that a product be specially manufactured for you (“Custom Product”). This can be a previously produced item, a new item, or an existing product modified to your specifications (e.g., material). Please note that custom products are not eligible for withdrawal from the contract as per §1837(d) of the Czech Civil Code.
2.2. A payment plan will be agreed upon at the time of your order. A minimum of 60 % of the total price must be paid within 14 days after the payment request. If the advance payment is not received in time, the order may be canceled without compensation. This deposit is non-refundable if canceled after production has started (see 2.3.2).
2.3. Refund conditions for custom product orders are as follows:

2.3.1. If the seller is unable to fulfill your order, all payments made up to that point will be refunded to you. The seller shall have no further liability to you beyond this.
2.3.2. If the order is canceled after production has begun, the buyer is liable for all incurred costs. In this case, the seller reserves the right to retain the deposit (see 2.2) to cover the cancellation costs.

2.4. The production start date is defined as:

2.4.1. The moment materials, tools, or parts are ordered (if not in stock)

3. Returns

3.1. The buyer has the right to withdraw from the purchase contract within 14 days of receiving the goods, in accordance with §1829 of the Czech Civil Code.
3.2. Withdrawal must be made in writing by sending a notice to: reklamace@rcmodelsfactory.com. A withdrawal form will be provided by the seller.
3.3. Notices submitted via unofficial channels (e.g., social media) will not be considered valid.
3.4. Goods must be returned to: Ondřej Lokaj, Jabloňová 251/31, Vyškov 682 01, Czech Republic within 14 days of the withdrawal notice. If goods are not physically shipped within this time, the withdrawal will be deemed invalid and the return will not be accepted.
3.5. Cash-on-delivery returns will not be accepted.
3.6. Return shipping costs are borne by the buyer.
3.7. If the buyer fails to collect the parcel and the seller withdraws from the contract as a result, the refund will be reduced by the shipping costs.
3.8. The buyer is liable for any reduction in the value of the goods caused by handling beyond what is necessary to determine its nature and features. Damaged, incomplete, or used items may only be partially refunded.
3.9. Parts of kits must not be damaged or removed from protective packaging, which prevents damage or mixing.
3.10. Goods are packaged to allow inspection similar to a physical store.
3.11. Scratching, mixing, gluing, filing, sanding, painting, or similar modifications render the product used and non-returnable. Goods removed from packaging that also serves as part identification cannot be returned.
3.12. The amount paid will be refunded without undue delay, no later than 14 days from withdrawal, using the same payment method, unless otherwise agreed. The seller may delay the refund until goods are received and inspected. The refund may be reduced by associated costs.
3.13. The seller must provide a justification for any deductions upon request.
3.14. Clearly damaged, incomplete, or excessively used goods will not be accepted. In such cases, the customer must cover the cost of return shipping. The goods will be returned only after payment of these costs.
3.15. All gifts or promotional items provided with the order must be returned.
3.16. Incomplete product returns (e.g., missing parts in a kit) will not be accepted and will be returned to the customer at their expense.
3.17. Any costs incurred to restore goods to original condition will be deducted from the refund.
3.18. Only the original buyer has the right to return the goods.
3.19. The right to withdraw does not apply to custom-made or personalized products.
3.20. Buyers are encouraged to retain proof of return shipping and insure the parcel. The seller is not responsible for lost or damaged returns during transport.
3.21. Goods damaged during return shipping will not be accepted and will be returned at the buyer’s cost.

4. Warranty

4.1. The warranty applies only to defects not caused by the buyer.
4.2. The seller is liable for defects that appear within 24 months of the buyer receiving the goods.
4.3. The warranty does not cover damage caused by the customer.
4.4. The warranty does not cover normal wear and tear.
4.5. The buyer acknowledges that some parts may wear out during normal use.
4.6. Spare parts included in the package are optional and not subject to complaint if missing.
4.7. The warranty does not cover damage from excessive load or overuse.
4.8. The warranty does not cover damage from exposure to extreme temperatures. Limits are stated in the manual.
4.9. The warranty does not cover misuse. Operating conditions are described in the manual.
4.10. The warranty does not cover poor maintenance. Maintenance instructions are provided.
4.11. Complaints must be resolved within 30 days of delivery to the seller.
4.12. The seller is not liable for damage caused by incorrect use or maintenance of the model.
4.13. The buyer is responsible for the safe and appropriate use of the product. The seller is not liable for any damage caused by unsafe or improper handling.
4.14. Claims must be submitted in writing to: reklamace@rcmodelsfactory.com
4.15. Claims submitted through unofficial channels (e.g., social media) will not be accepted.

4.18. The seller is not liable for damage caused by improper assembly or use in violation of instructions. Such damage is not covered by the warranty.
